Terms and Conditions
These Terms and Conditions ("Terms") govern your purchase and use of Atlas (the "Software"), a desktop application sold by Chamanes de la Península ("we", "us", "our"). By purchasing, downloading, installing, or using the Software, you agree to these Terms. If you do not agree, do not purchase or use the Software.
1. The Software
Atlas is a desktop application for creating and managing interactive maps, wikis, and notes for tabletop role-playing campaigns. It runs locally on your own computer. Your campaign data (projects, maps, images, articles) is stored on your device, not on our servers.
2. Eligibility
The Software is intended solely for users who are 18 years of age or older. By purchasing or using the Software, you represent and warrant that you are at least 18 years old. We do not knowingly sell to or collect data from minors.
3. License grant
When you purchase a license, we grant you a non-exclusive, non-transferable, perpetual license to install and use the Software for your personal or internal use, subject to these Terms.
- One license may be activated on up to two (2) computers simultaneously.
- The license is perpetual: a single payment, with no recurring subscription. You may keep using the version you have indefinitely.
- Players connecting to a licensed user's session over a local network ("LAN players") may view shared content for free and do not require their own license.
4. License activation and validation
Activating the Software requires a valid license key, which is bound to your computer using a device identifier (your machine's hostname). The Software contacts our payment provider's licensing service (Lemon Squeezy) to activate and to revalidate periodically (approximately every 15 days). The Software includes an offline grace period of approximately 15 days during which it continues to work without an internet connection.
You may deactivate a computer from within the Software (e.g. before selling or replacing it) to free an activation slot. We may revoke a license obtained through fraud, chargeback, or breach of these Terms.
5. Restrictions
You may not:
- Resell, sublicense, rent, lease, or redistribute the Software or your license key;
- Share your license key publicly or with people outside your two permitted installations (LAN players excepted, as described above);
- Reverse engineer, decompile, or disassemble the Software, except where such restriction is prohibited by applicable law;
- Remove or alter any proprietary notices;
- Use the Software for any unlawful purpose.
6. Ownership
The Software, including its code, design, user interface, icons, and branding, is owned by Chamanes de la Península and is protected by copyright and other laws. These Terms grant you a license to use the Software; they do not transfer any ownership rights to you.
Your content remains yours. Any maps, text, images, and campaign data you create or import using the Software belong to you. We claim no ownership over, and have no access to, your content (see the Privacy Policy).
7. Payments, taxes, and Merchant of Record
Payments are processed by Lemon Squeezy, which acts as the Merchant of Record for all purchases. This means Lemon Squeezy handles the transaction, collects and remits applicable taxes (such as VAT/sales tax), and appears on your payment statement. Your purchase is also subject to Lemon Squeezy's Terms of Service and their handling of your payment information.
8. Refunds
Atlas is a digital product delivered immediately. Refunds are handled by Lemon Squeezy as the Merchant of Record and are subject to Lemon Squeezy's refund policy. If you believe you are entitled to a refund or the Software does not work as described, contact us at [email protected] and we will help process the request through Lemon Squeezy.
9. Updates
We may, but are not obligated to, release updates, bug fixes, or new versions. The Software may check for updates by contacting a software repository on startup. Updates are provided under these same Terms unless a new version is accompanied by new terms.
10. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
You are responsible for backing up your own data. We are not responsible for any loss of campaign data.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMANES DE LA PENÍNSULA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Termination
These Terms remain in effect until terminated. Your license terminates automatically if you breach these Terms. Upon termination, you must stop using and uninstall the Software. Sections 6, 10, 11, and 13 survive termination.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at https://www.atlascompendium.co/terms. Continued use of the Software after changes take effect constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of the United Mexican States (Mexico), without regard to its conflict-of-law rules. Any disputes will be subject to the competent courts of Mexico.
